Introduction
This Privacy Policy describes how Farmium (“Company”, “we”, “us”, or “our”) collects, uses, stores, and protects personal data in connection with the Farmium platform available at https://app.farmium.ai, our website at https://farmium.ai, and the Farmium API (collectively, the “Service”).
This Privacy Policy applies to all users of the Service (“Users”, “you”), including those who access the Service through the web dashboard, CLI, or API. It forms part of and must be read together with our Terms of Use, Acceptable Use Policy, and Usage Guidelines. By using the Service you agree to the practices described here.
We are committed to protecting your privacy and complying with applicable United States federal and state privacy laws (including laws that may apply to residents of specific states such as California), and other data protection and privacy laws in jurisdictions where we operate.
Service Not Intended for Minors
The Service is not intended for individuals under the age of 18. We do not knowingly collect personal data from children under 18. If we become aware that we have collected data from a child under 18, we will delete it. If you believe a minor has provided us with personal data, please contact us at hi@farmium.ai.
Data Controller and Data Processor
3.1 When we act as data controller
For the purposes of applicable data protection laws, Farmium is the data controller of the personal data we collect to provide, administer, and secure the Service. This includes your account information, billing data, and technical/usage data.
3.2 When we act as data processor
When you use the Service to create, upload, or deploy content (including through the API, CLI, or Dashboard), and that content contains personal data of third parties, you are the data controller of that data and we act as your data processor. We process such data strictly on your instructions and in accordance with your agreement with Farmium.

Personal Data We Collect
4.1 Data you provide directly
Email address
Account credentials (passwords stored in hashed form)
Team and sub-account information (if applicable)
User-generated content and creatives that you upload, generate, store, or manage in “Collections”
Prompts and instructions you provide to the AI generation features
Content submitted for posting through the API or CLI
Niche, targeting, and warmup configuration information you provide for managed Accounts
4.2 Data relating to managed Accounts
If you use the Farmium managed account service (where Farmium provisions and maintains Accounts on your behalf), we process Account-level data including account identifiers, posting activity, engagement metrics, and content deployed through those Accounts. This data is processed on your instructions and in accordance with your agreement with Farmium.
4.3 Automatically collected data
We automatically collect limited technical and usage data such as IP address, browser type, device information, operating system, access times, API call logs, and interaction logs. This is used for security, fraud prevention, billing, and service optimization.
4.4 Payment information
Payments are processed exclusively by third‑party payment processors. We do not store full payment card details or other sensitive payment information.
4.5 Sensitive personal data
We do not intentionally collect special‑category (sensitive) personal data. You must not upload or process sensitive personal data unless you have a valid lawful basis. Any such data included in User Content is processed strictly on your instructions (we act as processor).
How We Use Your Personal Data
We use personal data to:
Create, manage, and secure your account (including team/sub-accounts)
Provide, operate, and improve the Service, including AI content generation, editing, workflows, storage in Collections, social media account management, and content deployment
Provision, warm up, and maintain managed Accounts on your behalf
Process payments and subscriptions
Provide customer support, onboarding, and training
Detect and prevent fraud, abuse, and security incidents
Comply with legal and regulatory obligations
Analyze usage (aggregated/anonymized where possible) for internal optimization
We do not use your personal data for marketing purposes and do not send promotional communications.
Legal Bases and U.S. Considerations
Where U.S. law requires or is relevant, we rely on appropriate legal bases for processing (contract performance, legitimate interests, legal obligations, and, where applicable, consent). For residents of states with specific privacy laws (e.g., California), additional rights and disclosures may apply as described below.
For User Content that contains personal data of third parties, you are the data controller and we act as your processor, processing on the basis of your documented instructions.
User-Generated Content and AI Processing
We do not monitor or review User Content as a matter of routine. When you use AI features, your prompts, uploaded assets, and generated outputs are transmitted to our third‑party AI API providers solely to fulfill your request. These providers are bound by data‑processing agreements and are prohibited from using your data for their own model training unless explicitly stated.
Content submitted through the API or CLI for posting to managed Accounts is processed by Farmium solely to execute your posting instructions. You remain responsible for the legality, accuracy, and compliance of all content you generate or distribute.
Data Sharing and Sub-processors
We share personal data only with trusted third‑party service providers, all bound by contractual obligations, including:
Cloud hosting and storage providers
Payment processors
Generative AI services used for image and video generation
Social media platforms when required to operate managed Accounts or execute your posting instructions
We do not sell your personal data. We may add or change service providers; new providers will be subject to equivalent contractual protections.
Cross‑Border Transfers
Some of our service providers are located outside the United States. Where data is transferred internationally, we implement appropriate safeguards and contractual protections required by applicable law.
For users in the United States, we process your data in accordance with applicable U.S. federal and state privacy laws.
Data Retention
We retain personal data only as long as necessary to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements:
Active account data and User Content: retained for the duration of your subscription
Upon cancellation or termination: we will delete or anonymize your account data within 180 days, unless required to retain it longer for legal or security reasons
Managed Account content deployed to third‑party platforms remains on those platforms and is subject to their retention policies
Payment-related records are retained by our payment processors per their obligations
Your Rights
Depending on your jurisdiction, you may have rights to: access, rectify, erase, restrict, or port your personal data; object to processing; withdraw consent (where applicable); and other rights under state laws (for example, the California Consumer Privacy Act for California residents). We do not sell personal data.

Security
We implement technical and organizational measures (encryption, access controls, secure infrastructure, audits) to protect personal data. No system is completely secure; if a breach is likely to result in a risk to rights and freedoms, we will notify affected individuals and authorities as required by law.
Cookies and Similar Technologies
We use strictly necessary session cookies for authentication, security, and basic functionality. We do not set advertising or non‑essential tracking cookies. Third‑party services embedded in the Service may set their own cookies — please refer to their privacy notices.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. Continued use of the Service after the effective date of any update constitutes acceptance of the updated policy.
